Post Nuptial Agreements
The use of pre nuptial, post nuptial and cohabitation/ living together agreements serve a useful purpose for some couples, but we recommend they are only undertaken with professional guidance. Here we provide some basic information about their use:
- Written Agreement entered into by couple after date of marriage/civil partnership
- More usually by a couple who did not complete the terms of a Pre Nuptial Agreement before the marriage
- Post Nuptial Agreement will cover the same issues that could have been dealt with in a Pre Nuptial Agreement - see (a), (b), (c) on Pre Nuptial Agreements.
WARNING
Like Pre Nuptial Agreements, Post Nuptial Agreements are not recognised under the Law of England and Wales. The same provisions under this heading as in Pre Nuptial Agreements apply.
